Grievance Process A grievance is an allegation that there has been a specific violation, misinterpretation, or improper application of an Article(s) and Section(s) of the Collective Bargaining Agreement by the State System or University and a statement of the remedy being requested. Therefore, a grievance must deal with a contract problem and include a method of resolution. Faculty Grievance Process There are four steps in the grievance process; if the grievance is not resolved at one step, it will move on to the next. Step One A faculty member, group of faculty members, or APSCUF should provide the grievance, orally or in writing, to the lowest management level with the authority to respond to the grievance. The management representative will investigate the grievance and respond to it orally or in writing. Step Two The grievant(s) will provide the President or the President's designee with the grievance in writing. The grievance must include the facts of the grievable event and the Articles and Sections of the Collective Bargaining Agreement that are being violated. The President will investigate the grievance, discuss the event with the grievant(s), and respond to the grievance in writing. Step Two must be completed within a specified timeline, which is 40 days from the date of the occurrence giving rise to the grievance or 40 days from the date on which the grievant learned of such occurrence. Step Three The grievant(s) may submit a written appeal of the President's decision at Step Two to the Chancellor or the Chancellor's designee. The Chancellor will respond in writing to the grievant(s) and APSCUF. Step Four APSCUF may submit the grievance for binding arbitration. It is important to note that only APSCUF has the right to take a grievance to this step - it can not be done by an individual or group of individuals. APSCUF must notify the Chancellor or the Chancellor's designee of the decision to submit the grievance for arbitration.
